All website owners who wish to register as Partners of YourSiteStats (referred to as "Partners") and use its services (referred to as "Services") must first of all read these Terms of Service and accept them before completing the YourSiteStats registration process.

  1. YourSiteStats provides its Services completely free of charge. Website publishers that wish to Partner with YourSiteStats must agree to and accept these Terms of Service by ticking the appropriate box during the registration process. You also agree that any registration information you give to YourSiteStats will always be correct and up to date. You further agree to the use of your data in accordance with YourSiteStats privacy policies.
  2. We reserve the right to change these Terms of Use at any time by amending this web page. Partners will be alerted to any change using the email address you supply to us during the registration process.
  3. To become a registered YourSiteStats Partner you must supply us, as a minimum, with company name, your name, email address, a password and the website URL's for those sites which you wish to receive analytics.
  4. After completing the registration process a Partner must place the supplied line of JavaScript code (the YSS Code) on each page of your website.
  5. In relation to the YSS Code, the Partner warrants:
    1. that it shall place no more than one YSS Code on a given page of their website(s);
    2. that it is legally entitled to place the YSS Code on such pages;
    3. that it shall not, and shall not authorise or permit any third party to:
      1. tamper with or otherwise modify any YSS Code; or
      2. place the YSS Code on any site that is not their own;
    4. that it shall remove any YSS Code that fails to function properly upon becoming aware of such a malfunction; and
    5. that, upon the termination of our Partnership, it shall remove each YSS Code from their site(s).
  6. The Partner warrants that their website(s) do not infringe any (a) intellectual property rights (including, without limitation, copyright), (b) data protection or privacy rights, or (d) other rights of any person or entity, nor (e) applicable law, rule, regulation, standard or code.
  7. YourSiteStats shall be entitled to use data supplied by a Partner and to aggregate Partner data with other data.
  8. For the avoidance of doubt:
    1. Partner Data shall not personally identify any user of the Property; and
    2. YourSiteStats shall keep Partner data confidential, and not disclose it to any third party, except in a form that does not identify the Partner with the Partner data.
  9. YourSiteStats Partners must include the supplied Privacy Disclosure Statement (or substantially the same statement) and opt-out Hyperlink in their privacy page or other prominent location for each site that you wish to activate analytics.
    Visitors to this site are served a cookie that allows us to collect aggregated statistics about visitors use of this site. We do this to help us improve the site and make it easier to use and more relevant to you. All data is anonymous and no personally identifiable information is processed or stored so individual users can never be identified. This anonymous data is not shared with any organisation other than our analytics partner who may use it for commercial purposes.   10. Following the completion of these processes we will review the content of your site(s) to ensure it meets our standards (see below) before activating your site analytics. This could take up to 24 hours. You will receive an email if we are unable to verify your content or if it fails to meet our standards.
  11. YourSiteStats will only Partner with websites containing content acceptable to the general public. We do not allow sites to Partner with us if their website contains the following types of content:
    1. Hate Content, Obscenity and Indecency
      • Content articulating views intended or reasonably likely to cause or incite hatred of any race, religion, creed, class or ethnic group.
      • Content articulating views calculated to cause offence to or incite hatred of any individual or group.
      • Content explicitly glorifying or delivering for the purposes of entertainment, scenes or descriptions of non-consensual pain, suffering, death, torture or ill-treatment of humans or animals.
      • Content that is obscene or indecent under prevailing legislation.
    2. Bombs/guns/ammunition
      • Content offering genuine or replica guns, bombs, ammunition or other offensive weapons for sale.
      • Content glorifying the use of or offering technical information on the illegal use of guns, bombs, ammunition or other offensive weapons.
    3. Spyware
      • Any software covertly installed on a user's machine (as distinct from the legitimate addition of a cookie to the appropriate location within the user's browser).
      • A sub-set of Spyware is malware (malicious code). A defining characteristic of malware is that it is intended to cause harm or be used for criminal purposes.
      • Examples of malware include keystroke loggers, password sniffers, spam launchers, remote access tools (RATs) or screen capture utilities. Malware may deliver viruses, worms or Trojans.
    4. Legality Generally
      • Any other content that infringes applicable laws or regulations, or the rights of any person or entity.
  12. YourSiteStats only processes anonymous, non-personal visitor data which may be used by a third-party for commercial purposes.
  13. To terminate Services by YourSiteStats simply advise us of this through our Help page and remove the JavaScript tags, Privacy Disclosure Statement and opt-out Hyperlink from your site(s) pages.
  14. YourSiteStats shall not be liable to Partners for any indirect or consequential loss or damage, or for any loss of data, profit, revenue, contracts or business, howsoever caused (whether arising out of any breach of this Agreement, any negligence of YourSiteStats or any other person or otherwise), even if YourSiteStats has been advised of, or should have been aware of, the possibility of any such losses arising.
